Abstract

With the deepening of the reform and opening up to the outside world, road traffic is developing at a terrific speed. However, traffic accidents increase dramatically due to imbalances in the development of automobiles and road conditions. According to Methods for Handling Road Traffic Accidents, the public security organs are in charge of dealing with traffic accidents. For long, the public security organs are responsible for taking of evidence and establishing liability, as well as for administrative penalty, criminal investigation and the mediation of civil remedies, without necessary internal and external supervision system. Handling cases in accordance with the procedure is not good for enforcing laws strictly and impartially, not tally with modern legal concept and has negative effects on establishing the legal state.
