2、采取欺诈手段订立本合同的;Adopted fraudulent means to enter into this contract.
3、严重违反劳动纪律或规章制度给甲方造成重大损害的;Seriously violated labor discipline or regulations to cause significant harm to the Party A.
4、严重失职、营私舞弊,或泄露甲方商业秘密,给甲方利益造成重大损失的;Gross negligence, malpractice, or disclosure of trade secrets Party A, to cause heavy losses to the interests of the Party A.
5、乙方同时与其他用人单位建立劳动关系,对完成本单位的工作任务造成严重影响,或者经用人单位提出,拒不改正的;Party A built labor relationships with other unit, to cause a serious impact on the completion of the tasks of the unit, or refused to correct the rules made by the employer
6、被依法追究刑事责任的。Be investigated for criminal responsibility according to law
(三)有下列情形之一的,甲方可以提前30日以书面形式通知乙方解除劳动合同:Of the following circumstances, Party A can give notice to inform Party B to terminate the labor contract ahead of 30 days.
1、乙方不能胜任工作,经培训或调整工作岗位仍不能胜任工作的;Party B is not competent for work, after training or adjustment of jobs.
2、乙方患病或者非因工负伤,医疗期满后,不能从事原工作,也不能从事甲方另行安排工作的;Party B was ill or injured due to non-work relation, after completion of medical, Part A is not competent for his original work, or alternative arranged jobs.
3、劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,双方协商不能就变更劳动合同达成协议的。If the objective situation this contract based on, changes significantly, to result the contract unable to perform, mutual consent can not be reached, in change of this labor contracts.
(四)有下列情形之一的,甲方可以提前30日通知工会,经工会同意后,与乙方解除劳动合同:Of the following circumstances, Party A can give notice ahead of 30 days, to inform the Labor Union, after agreement, Party A may terminate the labor contract.
1、甲方依照企业破产法规定进行重整的;Party A restructured pursuant to the Enterprise Bankruptcy Law
2、甲方生产经营发生严重困难的;Production and business operation of Party A met serious difficulties.
3、甲方转产、重大技术革新或者经营方式调整,经变更劳动合同后,仍需裁减人员的;production, technological innovation or business method of Party A adjusted, after the change of labor contracts, still needed to reduce staff.
4、其他因劳动合同订立时依据的客观经济情况发生重大变化,致使劳动合同无法履行的。If other objective situation this contract based on, changes significantly, to result the contract unable to perform.
(五)乙方有下列情形之一的,甲方不得解除劳动合同:Of any of the following circumstances, party A can not terminate the labor contract.
1、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;Injured due to occupational disease or work-related reasons, and was confirmed as having lost or partially lost the ability to work.
2、患病或者非因工负伤,在规定的医疗期内的;Illness or non-work related injury within the
